By engaging Gill Truck & Trailer Services ("Company," "we," "us," or "our") for any services, including but not limited to heavy duty repair, light duty repair, mobility services, trailer repairs, truck repair, body shop work, emergency repair services, specialty vehicle services, truck sales, leasing, rentals, telematics, or parts and accessories sales, you ("Customer," "you," or "your") agree to be bound by these Terms and Conditions ("Terms").
The Company reserves the right to modify these Terms at any time. Any modifications will be effective immediately upon posting on our website. Your continued use of our services following any modification constitutes your acceptance of the modified Terms.
The Company reserves the right to refuse service to anyone at any time for any reason not prohibited by law.
All repair estimates are approximations. Final charges may vary based on actual parts required, labor time, and unforeseen complications discovered during repair.
Diagnostic fees will be charged regardless of whether you proceed with recommended repairs. These fees will be disclosed prior to service commencement.
Written or electronic authorization is required before any repair work begins. Emergency repairs may require verbal authorization to be followed by written confirmation.
All trailers will undergo a safety inspection upon intake. Additional defects discovered during repair may result in mandatory repairs as required by law or safety standards.
All trailer repairs will conform to Department of Transportation (DOT) standards. Additional work may be required to bring trailers into compliance, which may affect estimated costs.
While every effort will be made to match paint colors, variations may occur due to age, sun exposure, or manufacturing variations in the original paint. The Company does not guarantee exact color matching.
The Company is not responsible for pre-existing damage discovered during repair. Such damage will be documented and communicated to the Customer before proceeding.
Emergency service requests are prioritized based on severity, safety concerns, and resource availability. The Company cannot guarantee an immediate response.
Additional fees apply for after-hours, weekend, holiday, or on-location emergency service calls. These surcharges will be disclosed before service is rendered.
Specialty vehicle services (including but not limited to refrigeration units, hydraulic systems, and specialized equipment) require specialized knowledge and parts. Longer lead times and additional costs may apply.
Mobility services are available within a designated service radius. Additional fees apply for services beyond this radius. The current service radius is available upon request.
Roadside services are limited to mechanical repairs that can be reasonably performed on-site. The Company reserves the right to require towing to our facility for comprehensive repairs.
Unless explicitly stated otherwise in writing, all used vehicles are sold "as-is" with no warranty expressed or implied. New vehicles are covered by manufacturer warranties as applicable.
All deposits for vehicle purchases are non-refundable unless otherwise specified in a written purchase agreement.
All rentals require a signed rental agreement. The renter must be at least 25 years of age with a valid commercial driver's license appropriate for the vehicle class.
Renters must provide proof of insurance meeting minimum coverage requirements specified in the rental agreement. Failure to maintain required insurance constitutes a breach of contract.
Renters are responsible for all damage occurring during the rental period, excluding normal wear and tear. A detailed inspection will be conducted at pickup and return.
Vehicles may not be used for illegal activities, racing, towing beyond capacity, or outside the continental United States without prior written authorization.
Parts purchased from the Company carry manufacturer warranties only. Labor for warranty parts replacement is not included unless otherwise specified.
New, unused parts in original packaging may be returned within 30 days with receipt for a full refund or exchange.
Special order parts are non-returnable unless defective.
All electrical components are tested prior to sale and are non-returnable once installed unless proven defective.
Telematics services require ongoing subscription fees. Service interruptions may occur due to cellular coverage limitations, system maintenance, or other factors beyond our control.
Customer data collected through telematics services is subject to our Privacy Policy. You acknowledge that certain vehicle and location data will be transmitted to our systems as part of the service.
Telematics hardware installed in vehicles remains the property of the Company unless explicitly purchased by the Customer.
We accept company checks, credit cards, debit cards, and approved commercial accounts. Personal checks require prior approval.
For repairs exceeding $2,500, a 50% deposit may be required before work commences.
Accounts past due for more than 30 days will incur interest at 1.5% per month or the maximum allowed by law. Accounts past due for more than 90 days will be referred to collections.
The Company reserves the right to place a mechanic's lien on any vehicle for which payment is not received within 60 days of service completion.
Labor is warranted for 90 days or 5,000 miles, whichever occurs first. Parts are warranted according to the manufacturer's terms.
Warranties do not cover damage resulting from accident, abuse, neglect, alteration, or improper maintenance. Failures caused by pre-existing conditions identified during initial diagnosis are not covered.
All warranty claims must be presented immediately upon discovery of the defect. Vehicles must be returned to our facility for warranty service.
The Company's maximum liability for any claim arising from services rendered shall not exceed the amount paid for such services.
The Company is not liable for any consequential, incidental, or special damages, including but not limited to loss of use, loss of profits, or business interruption.
The Company is not responsible for personal property left in vehicles. Customers are advised to remove all personal belongings prior to service.
Vehicles left at our facility for more than 5 business days after service completion will incur storage fees of $50 per day unless prior arrangements are made.
Before initiating any legal proceeding, Customers agree to attempt to resolve any dispute informally by contacting the Company's management.
Any dispute not resolved informally shall be resolved exclusively through binding arbitration in accordance with the American Arbitration Association's Commercial Arbitration Rules.
Any arbitration or legal proceeding shall take place exclusively in [YOUR COUNTY, STATE], and you consent to jurisdiction and venue in such location.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Failure of the Company to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
The Company shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including acts of God, natural disasters, pandemic, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, flood, accident, or strikes.
These Terms constitute the entire agreement between you and the Company regarding the services and supersede all prior agreements and understandings, whether written or oral.
